1. Acceptance of Terms & Scope of Services

By accessing or using this website (yash.mittalz.co.in / Yosmos), purchasing single article digital access, booking consulting hours, or acquiring podcast sponsorship placements, you explicitly agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our services or complete payment transactions.

2. Strict Non-Refundable Payment Policy

All sales, unlocks, consulting bookings, and sponsorship fees are final and strictly non-refundable. Due to the immediate delivery of digital intellectual property, digital content unlocks, and allocation of personalized advisory or broadcasting calendar slots, transactions cannot be cancelled, reversed, or refunded once processed via Stripe.

No pro-rated refunds, partial refunds, or discretionary cash chargebacks will be granted for any reason, including but not limited to buyer's remorse, changed circumstances, or failure to access digital content.

3. Service Substitution Guarantee (Alternative of Equal Value)

In the rare and unexpected event that a scheduled or purchased service (such as a 1-on-1 Brand Consultation call or a dedicated Podcast Sponsorship slot) cannot be performed or delivered by Yash Mittal due to emergency circumstances, insurmountable scheduling conflicts, technical outages, or force majeure events, our sole obligation and your exclusive remedy is as follows:

• Service of Equal or Greater Value: You will be provided with an alternative consulting deliverable, asynchronous strategic teardown, promotional placement, or comparable service of equal or greater monetary value.
• Rescheduling Priority: For consultation calls, you will be offered immediate priority rescheduling to a mutually agreeable future calendar slot.
• No Cash Restitution: Under no circumstances will service non-delivery result in cash refunds or punitive damages. The provision of substitute services of equal value represents full satisfaction of all contractual obligations.

4. Non-Negotiable Pricing & Discretionary Rate Adjustments

No Price Negotiation: All rates and fees listed across our Pricing Page are standardized, fixed, and non-negotiable. We do not accommodate custom discounting, haggling, or post-purchase price matching.

Price Changes at Our Sole Discretion: We reserve the right to modify, adjust, raise, or alter the pricing of single article unlocks, consultation sessions, sponsorships, or any future product offerings at any time without prior written notice. Existing active purchases or confirmed bookings will remain unaffected by subsequent price adjustments.

5. Modification of Terms at Our Will

We reserve the unrestricted right to modify, amend, replace, or update these Terms and Conditions at our sole will and discretion at any time. Any changes become effective immediately upon posting to this URL. Your continued use of the platform, maintenance of an account, or engagement with paid content following the posting of updated terms constitutes your affirmative and irrevocable acceptance of those changes.

6. Limitation of Liability & Disclaimer of Warranties

To the maximum extent permitted by applicable law, Yash Mittal, Yosmos, and its affiliates, contractors, and agents shall not be liable for any direct, indirect, incidental, special, consequential, exemplary, or punitive damages whatsoever.

This includes, without limitation, damages for loss of profits, goodwill, business opportunities, data loss, interruption of business, or commercial impact arising out of or related to your use of this site, reliance on consulting advice, podcast advertising performance, or technical failures. All editorial content, technical write-ups, and consulting opinions are provided strictly on an "as is" and "as available" basis without warranties of any kind, whether express or implied.

7. Digital Content Licensing (Single Article Unlocks)

When you purchase a Single Article Unlock ($10), you receive a personal, non-exclusive, non-transferable, revocable license to read and access that specific publication for your personal or internal reference. You may not republish, resell, scrape, distribute, redistribute, or create derivative works from the proprietary text, diagrams, code, or research contained within unlocked articles.

8. Account Synchronization & Guest Email Matching

When checking out as a guest, your unlock entitlements are matched to the email address provided during checkout. You may access your unlocked content across devices by signing in with Google using that same email address. It is your sole responsibility to provide an accurate, accessible email address during checkout.

9. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of California, United States, without giving effect to any principles of conflicts of law.
